MOUNT PLEASANT, S.C. (WCIV) — A long-running dispute over a parking garage project along Shem Creek will return to a lower court after the South Carolina Supreme Court found the Town of Mount Pleasant breached its contract with the developer but left damages unresolved.

In a Nov. 12 ruling, the justices affirmed that the town wrongfully derailed the project by imposing regulatory hurdles after public backlash, effectively stalling construction. The Shem Creek Development Group terminated its contract in 2017 and sued, alleging the town’s actions amounted to an anticipatory breach.

The developer was initially awarded more than $2.6 million in damages plus nearly $300,000 in attorneys’ fees after a circuit court found the town at fault. The state Court of Appeals upheld that ruling in 2024.

However, the Supreme Court determined that the section of the contract governing damages, specifically the phrase “rent payments due under this agreement,” was ambiguous. Justices said it was unclear whether the town owed only the rent accrued before the project’s termination or the full 15 years of payments originally agreed to.

The case now returns to circuit court, where a new trial will determine the parties’ intent and whether the damages clause represents a valid liquidated damages provision or an unenforceable penalty. The court also ordered additional discovery into the garage’s financial records to help calculate any potential award.

The dispute began after Shem Creek Development Group proposed building, owning and operating a parking garage near Shem Creek, with the town agreeing to lease 132 spaces at $185,000 annually. But after vocal community opposition, town leaders moved to slow or alter the project. It was a move the Supreme Court described as a “remarkable campaign of regulatory nitpicking.”

The court’s decision now adds to the nearly decade-long legal battle and sends the financial questions back to the trial court for resolution.

MOUNT PLEASANT — The state Supreme Court ruled the town breached its contract for a parking garage near Shem Creek, but left it up to a trial court to rehash how much officials will owe developers for the bungled deal.

The ruling marks a new turn in the nearly decade-long litigation with millions of dollars at stake.

The decision from the state’s highest court Nov. 12 tossed out the $2.6 million damages previously awarded to the developers, plus more than $1.2 million in interest, but upheld parts of a 2020 judgment that said Mount Pleasant had breached the contract with Shem Creek Development Group.

At the center of the case is a multi-level parking garage and office complex on Coleman Boulevard — a development the town supported, but then opposed after a local election in which the parking garage was a key issue.

The town had agreed in 2013 to pay $185,000 in annual rent over 15 years in exchange for public parking spots in the garage. The waterfront is a popular area for outdoor recreation and nightlife, and the development was meant to improve parking there.

But leaders pulled out of the deal in 2015 after facing vocal citizen opposition and mounting pressure from residents. Construction of the garage moved forward anyway and the parking deck was completed in 2017.

Mount Pleasant Town Council declined offers from the developers to pay reduced rent for fewer public parking spots. Leaders voted to reject this proposal, as well as any future offers the developers may have made.

Shem Creek Development Group, led by Tyler Flesch and Tex Small, sued the town in 2017. The town owed them the full sum of the agreed-upon rent, they argued.

Circuit Judge Maite Murphy ruled in favor of the developers in 2020. Mount Pleasant was to pay roughly $2.6 million in damages, plus an additional $289,000 in legal fees.

The town’s stance was that they weren’t on the hook for rent and asked that the case be reheard. The Court of Appeals denied that request in March 2024. The town appealed again, this time to the state Supreme Court.

“We are happy that the South Carolina Supreme Court agreed with the argument that the Town has been making for many years. We look forward to the final resolution of this case,” Mount Pleasant Town Administrator Eric DeMoura said.

Brandon Gaskins, attorney for the developers, said his clients are pleased the state Supreme Court upheld the previous rulings. Allowing the trial court to reevaluate the damages owed “allows for Shem Creek Development Group to recover significantly more damages than we initially sought,” he said.

“We’re pleased the Supreme Court rejected the Town’s attempt to avoid any liability for its bad faith actions and affirmed the trial court’s ruling that the Town breached the parking license agreement. With that question firmly decided, the only issue remaining for determination is the amount of damages owed by the Town,” Gaskins said. “We are looking forward to proving those damages once again.”

None of that should be surprising. The majestic structure complements the beauty of the rivers and saltwater marshes, affording a view unlike any other. It’s more than just a way to get from one side to the other; it’s a destination in itself.

The Ravenel Bridge, which turned 20 this year, replaced two aging bridges: the John P. Grace (or the “old Cooper River Bridge”), built in 1929, and the Silas M. Pearman (aka the “new bridge”), built in 1969. Both of those bridges were also icons – the Grace for providing a death-defying (some say thrilling) driving experience and the Pearman for offering a reversible lane whenever needed. But when driving on either, the goal was to get over them as quickly and safely as possible. The experience is forever etched into the memory of anyone who crossed the twin bridges – and still causes some to quake.

When the Ravenel Bridge was completed in 2005, the entire bridge, including the traffic lanes, was open to pedestrians for two days before automobiles were permitted to cross. That gave people a unique opportunity to enjoy the view without the distraction of vehicular traffic, and for many, to confront the fears that still lingered from crossing the two previous bridges. Now, with traffic whizzing by just feet away, pedestrians and bicyclists flock to the special lane on the bridge, made just for them, to enjoy a bird’s-eye view of the harbor. Even commuters can’t help but take a quick glimpse at the breathtaking panorama.

The older bridges shared the limelight in their day, but safety had become an issue on the antiquated and rusting duo. However, there was another consideration in erecting the Ravenel Bridge. With the shipping industry propelling much of the area’s economy and container ships becoming larger, a new bridge had become a necessity. Mega freighters needed to be able to pass underneath on their way to and from the port terminals, but that wasn’t possible with the lower height of the earlier structures. The roadbed of the Ravenel soars 186 feet above the river, providing vessels with safe clearance.

In the 1990s, a new Cooper River bridge was one of a handful of major infrastructure priorities across the state. As is often the case, funding presented a challenge. The State Infrastructure Bank was created to finance the statewide projects, but communities were required to pay a share of those being considered. Residents opposed both a toll and an increase in sales tax to provide the money. Ultimately, Arthur Ravenel Jr., the state senator representing Mount Pleasant at the time (and eventual namesake of the bridge) helped to forge local, state and federal partnerships and bridge the chasm that usually defines politics.
